Back then age of consent laws sucked in Alabama and hadn't caught up with the other laws related to them. So he didn't get in trouble for sleeping with the girl. That part was back then was, sadly, legal.

He got in trouble for recording it which was illegal.

There were a few shady circumstances surrounding it which got him off.

The girl and her 23 year old friend used fake IDs to get into a night club. Lowe was drunk, claims he thought she was older because she "looked" older, was with her older friend, and he didn't have a reason to think otherwise since the club let her in.

He said he was going to record their encounter. The three then, you know, and he drunkenly passed out.

The girl and her friend stole money from his wallet while he was drunk and passed out, then took the tape. Her mother found out about it and turned him in. The police questioned him about recording it. The mother then decided to sue him in a civil suit. The father (who the mother wasn't with) then tried to get a separate suit together and sue him also. The girl had a falling out with both her parents over it as she didn't want the attention. Lowe's people claimed the parents were trying to extort money from him and drew attention to the fact that she was hanging out with an older woman and using fake ids to get into clubs.

Luckily the judge only threw out the father's lawsuit since he wasn't even much involved in the girl's life but it hurt the mother's case since the father went for a money grab.

Eventually, he settled with the mother for a sum of money and got community service for the recording. Don't get me wrong, it's all disgusting but the whole thing was a hot mess.

The tape online is not that tape. (Thank goodness!)

The one online is one he made with his friend and a woman they knew. That friend then stole the tape and sold it. Since the woman was of age and the guy in the video technically sold it to video distributors because he was also in it, that one is still floating around today.
